A visa overstay frightens foreigners in Thailand more than almost any other problem. Plenty of scary stories circulate, some of them exaggerated and some completely true. Some people say that a single day over the limit can get you banned from the country. Others insist that nothing serious will happen because you simply pay a fine. The truth lies somewhere in between, and a lot depends on the circumstances.
In this article we will calmly explain what an overstay is, how much it costs, how one day over differs from several months over, what to do if you have already missed your date and, most importantly, how to avoid ending up in this situation. We rely on what is known at the time of writing, but immigration rules change, so in doubtful cases it is best to check the current requirements.
An overstay means that you remain in Thailand longer than your stamp or visa allows. Every entry and every extension comes with a specific date until which you may stay in the country. That date is marked in your passport. If it has passed and you are still in the country, you are breaking the law.
It is important to tell apart two dates that are easy to confuse. The first is the validity of the visa itself, meaning the period during which it can be used to enter the country. The second is the permitted period of stay, which is stamped in your passport at entry or at an extension. It is the second date that decides how long you may remain. People often look at the visa, see a distant date there and think they have plenty of time. In reality the stamp with the date is what counts, and it must be checked separately.
An overstay begins on the day after your permitted stay ends. From that moment every day over the limit counts as a violation, and each one is included when the fine and the consequences are calculated.
The basic rate is 500 baht for every day of overstay. You pay this fine when you leave the country. When you approach the immigration desk at the airport, the officer counts the days and tells you the amount.
There is an upper limit. The total fine at this rate is capped, and in practice the maximum is 20,000 baht. It is best to verify the exact figures against current sources, because the rules are refined from time to time.
Let us work through a simple example. If you are three days late, the fine is 1,500 baht. If you are ten days late, it is 5,000 baht. If you are a month late, it is 15,000 baht. You can see how quickly the amount grows, which is exactly why putting the problem off does not pay.
But money is not the heaviest consequence. For many people the bigger question is what will happen to their right to come back. That is the subject of the next section.
If the overstay is short and you leave the country voluntarily after paying the fine, an entry ban usually does not apply as long as you stay under a certain threshold. That threshold is ninety days.
If you overstayed by more than ninety days but less than a year, you may receive an entry ban of one year. For an overstay of more than a year, the ban usually grows to three years. For even longer periods it increases further and can reach ten years. These terms depend on the circumstances and on the decision of immigration.
It is worth mentioning separately the situation in which you are detained instead of coming to immigration voluntarily. The consequences are then more serious. Detention, deportation proceedings, a longer entry ban and possibly time in a temporary holding centre until you leave. You should avoid this scenario at all costs.
The difference between leaving voluntarily and being detained is enormous. So if you realise that you are late, the key decision is to act immediately instead of hiding and hoping that it will pass.
The first rule is to stay calm. Panic and inaction only make things worse. Count how many days you are over and work out the scale of the problem.
If the overstay is short, two paths are usually considered. The first is to leave the country, pay the fine and come back on a new basis. The second is to go to immigration and ask them to resolve the situation. In some cases immigration may accept your documents and collect the fine, especially if the delay had a valid reason and you came forward yourself.
Valid reasons include confirmed illness, hospitalisation, a cancelled flight or force majeure. You need to collect the documents that prove the circumstances and bring them with you. These are hospital certificates, confirmations from the airline and any papers that explain why you could not leave or apply on time.
Do not invent reasons and do not forge documents. That creates far more serious problems. An honest explanation with proof works better than any trick.
If the overstay is already significant, aim for a voluntary exit and get advice from a specialist. It is useful to contact your school or a lawyer who knows the practice. Do not trust intermediaries who promise to “solve everything without consequences” for a large sum. Such promises usually turn out to be empty.
Students have it easier than many others because they have a structure around them. The school tracks deadlines, reminds you about extensions and supports the filing of documents. Even so, the responsibility remains yours, and a few habits help you avoid mistakes.
Keep a calendar of visa dates on your phone. Mark the end of your permitted stay, the date of your next report and the day when you should start preparing the extension documents. Set a reminder two weeks and one week before the date. It is a very simple thing, but it prevents most problems.
Check your stamp after every extension. The officer may have written the date with an error, or you may have remembered it incorrectly. Compare the date in your passport with the one in your calendar.

Finally, plan your trips with your deadline in mind. If you travel, make sure you will be back before the permitted period ends and that you have a re-entry permit. Without it, the trip itself will cost you your extension.
There is another kind of violation that is often confused with an overstay. It is being late with the report on your place of residence, which must be submitted every ninety days. It has nothing to do with the validity of your visa, but it is also penalised.
If you are late with this report, a fine applies, usually a small one compared with a visa overstay. It can be increased if the violation is found during a check rather than when you come to immigration yourself. So keep your report calendar as carefully as your extension calendar.
Submitting the report is linked to another procedure. Sometimes you may be asked for confirmation of the notification filed by your landlord. You can read more about it in the article on the TM.30 notification. If it was filed on time, the report goes through without complications.
There are many myths around this topic that lead people to wrong decisions. Let us go through the most common ones.
Myth one. One day over does not count. In fact it does count, and a fine will be charged. With short delays the consequences are limited to money, but you should not treat it as normal.
Myth two. If you leave and come straight back, everything is reset. You can leave and return, but the fine and the record of the violation remain. Your border crossing history will also be looked at more closely.
Myth three. You can arrange it on the spot. Trying to settle the matter unofficially usually leads to new problems. Any informal offers from officers or intermediaries carry risk.
Myth four. Immigration will not find out. The immigration database records all entries and exits. Information about an overstay is stored and taken into account in later dealings.
Myth five. If I have a ticket for a date after my permitted stay ends, there will be no problem. A ticket does not extend your permitted stay. You are obliged to leave by the end date or to extend it officially.
There are situations in which a person truly cannot leave the country on time. Serious illness, injury, hospitalisation, closed borders, cancelled flights. In such cases immigration may be understanding if you contact them in advance or right after the event and can prove the circumstances.
If you are ill, keep every document from the hospital. Go to immigration as early as possible, preferably before the date your stay ends. Many issues are easier to settle when the officer can see that you are not trying to hide.
If a flight is cancelled, get confirmation from the airline. It can show that you intended to leave on time. Rebook your ticket for the nearest possible date straight away and tell immigration about it.
In any non-standard situation your main resources are honesty and documents. The better prepared you are and the sooner you come forward, the higher the chance of resolving the issue gently.
To get a feeling for the scale, here is a table of examples. It is based on the basic rate of 500 baht per day and does not take any additional circumstances into account, so the real amount in your case may differ.

The first day of overstay counts just like the others. The last day of your permitted stay is included in the period when you are in the country legally. The next day is already an overstay. If you fly out early in the morning on the day after your permitted stay ends, that is also one day of overstay.
Pay attention to the time zone and the departure time. If your flight leaves after midnight and your permitted stay ends on that day, you will in fact be leaving on the following day. People often fall into the trap of thinking that a ticket for the last day is enough. Check your departure time and never leave yourself with zero margin.
If you decide to leave and pay the fine, the procedure is fairly simple. You arrive at the airport early, go to the immigration desk for departures and hand over your passport. The officer sees the overstay, counts the days and names the amount. You pay the fine, receive the stamp and go on.
Give yourself extra time. When there is an overstay, processing takes longer than usual, especially at peak hours. Do not arrive an hour before departure hoping that everything will go quickly. Plan for a margin of two to three hours.
Bring cash in baht. Although card payment is available in many places, in practice it is better to have the needed amount with you. If you run short of money, you will face difficulties that are easy to avoid.
Never try to convince the officer that there is no overstay. The data is visible in the system. Calm and polite behaviour works better than any argument. If you have documents that prove the circumstances, present them at once.
This is one of the most frequent questions. The answer depends on the length of the overstay. After a short overstay, once the fine is paid and you have left voluntarily, you can generally come back. You will receive a new stamp on general grounds and start a new period.
But returning does not mean everything is forgotten. Information about the previous overstay remains in the database. In later dealings officers may notice it. That does not mean you will be refused, but some procedures may be examined more closely.
If the overstay exceeded ninety days, an entry ban becomes a real possibility. In that case you will not be able to come back without special permission until the ban ends. For anyone building a life in the country, the consequences of a serious overstay are usually too expensive.

A student visa does not release you from the duty to watch your deadlines. Moreover, students have an additional aspect. The extension of a student visa is tied to your studies. If you have overstayed, the visa cannot be extended on the previous basis and the matter will have to be resolved in another way.
The school finds itself in a difficult position in such a case. It cannot change the law and has no right to promise that the overstay will be “closed”. But it can help you understand your options, prepare documents and accompany you to immigration, if the situation allows it.
That is exactly why prevention matters more than cure. A school that carefully follows your deadlines and reminds you about them effectively insures you against most problems. Suppose you look at the calendar and realise that only a few days remain until your deadline. There is no need to panic if you act calmly and in order.
First check the date in your passport and make sure you understand it correctly. Then decide what you need. To extend your stay, change your status or leave. If you need to extend, gather the documents immediately and book a visit. If you need to leave, buy a ticket and check the departure time. If you are not sure, contact your school or a visa specialist.
Do not postpone anything until the last day. Any small thing, whether immigration being closed for a holiday, a queue or a missing paper, can cost you extra days. It is better to have a margin of several days than to sit in tension.
And finally. If you understand that the situation is getting out of control, ask for help right away. The sooner you speak up about the problem, the more options you have. Silence and hope for luck have never saved anyone.

"Отличная школа. По ценам сразу всё говорят, так что будет вся картина где, сколько и за что надо платить. Если будут возникать вопросы как сделать банковскую карту, как сделать реэентри, бордер и тд, в этом тоже подскажут и помогут. Везде стоят кондеи, есть место где можно чай/кофе/водичку попить, печеньки и тд. Есть несколько языков, если вы хотите серьёзно учиться) знаю ребят, кто ходит на тайский и они уже прям могут пообщаться, не просто 20-30 фраз и слов, которые за год тут, как мне кажется, само собой выучиваются. Здесь отличные, отзывчивые преподаватели, способные поддержать любой диалог и стремящиеся дать вам максимум знаний, за ограниченное длиной курса, время. Немаловажным для меня, было наличие в классах кондиционера и то, что все учебные материалы - бесплатно предоставляются школой. В группе есть симпатичные девушки, if you know what i mean ;) Кстати, если вас интересует бордерран, такая услуга тоже есть, а работать с русскоговорящим руководителем Никитой - одно удовольствие! Однозначно рекомендую!

Получил в школе консультацию на русском языке. После оплаты годового обучения школа сделала мне учебную визу, учу английский у носителя языка. Есть классы для любого уровня владения английским, также можно учить тайский по желанию. Оперативная обратная связь и высокое качество обучения, удобное место - всем рекомендую эту школу!
